Fibre optics in northern Saxony: Luther advises district on broadband tendering

By the end of 2020, 43,300 households in northern Saxony will benefit from fast Internet access. The contract for the Europe-wide tender procedure was awarded to Telekom Deutschland GmbH. Luther Rechtsanwaltsgesellschaft advised the district Nordsachsen on key steps in the infrastructure project.

The broadband expansion in northern Saxony is in the starting blocks. Telekom Deutschland GmbH won a Europe-wide tender. The company will lay around 900 kilometers of fiber optic cable in the project area by the end of 2020 to connect households, schools and industrial estates to the high-speed network. The district of Nordsachsen will receive funding of around EUR 97 million from the federal government and the Free State of Saxony.

Luther provided comprehensive legal support to the district of Nordsachsen in the tendering process for the project with a total of six clusters for development areas, starting with the structuring and implementation of the procedures through to contract negotiations. As part of the project, Luther also advised the district on subsidy law - in particular with regard to the federal subsidy for broadband expansion and the DiOS subsidy directive in Saxony. After the Federal Network Agency had reviewed the grant agreements, Telekom Deutschland GmbH was awarded the contract. At the beginning of July, the symbolic go-ahead was given for the project, which will use Internet speeds of up to one Gbit/s to make many regions in northern Saxony more attractive for families and companies.
